Moussa Balde è morto di razzismo

Il 14 ottobre al tribunale d’Imperia è iniziato il processo a tre italiani che il 9 maggio 2021 aggredirono brutalmente Moussa Balde a Ventimiglia. L’aggressione avvenne in pieno giorno in via Ruffini tra un supermercato e gli uffici della polizia di frontiera. 

Gli imputati sono a processo per lesioni aggravate dal numero di persone e dall’uso dell’arma, una spranga in questo caso, e sono difesi dall’avvocato Marco Bosio, noto per essere stato il difensore degli imputati nei processi contro la criminalità organizzata nel Ponente Ligure,  conosciuti come “SPI.GA” e “La Svolta”. Gli aggressori sono stati denunciati a piede libero in seguito a un video della violenza che ha fatto il giro del web, nel quale gli imputati sono riconoscibili. 

Il giorno stesso dell’aggressione il questore d’Imperia si affretta a fare dichiarazioni escludendo la matrice razziale delle violenze, che gli imputati giustificano come reazione ad un fantomatico tentato furto con una nullità di prove. 

Resta evidente il razzismo istituzionale che mette in atto un protocollo non per tutelare la vittima del linciaggio, ma piuttosto le persone italiane incriminate dal video filmato da un balcone.

Infatti in seguito all’aggressione Moussa Balde, originario della Guinea, viene portato all’ospedale per trauma facciale e lesioni, medicato e dimesso il giorno stesso, portato in commissariato viene consegnato all’ufficio immigrazione e, controllata la sua irregolarità sul territorio, viene recluso nel CPR (Centro di Permanenza per i Rimpatri) di Torino in attesa d’espulsione. 

Allontanato da Ventimiglia Moussa è finito al CPR senza aver mai firmato nessuna testimonianza sulla sua aggressione e senza che gli sia stata posta alcuna domanda sullo svolgimento dei fatti. Non ha ricevuto nessuna visita psicologica ma è stato rinchiuso a Torino, dove per diversi giorni gli avvocati non sono riusciti a rintraccialo perchè Moussa era stato registrato al CPR con un nome diverso da quello segnato dalla questura di Imperia. 

In una cella dell’area d’isolamento, denominata Ospedaletto, del CPR di Torino Moussa Balde muore la notte tra il 22 e il 23 maggio. I compagni di prigionia, che hanno iniziato una protesta quando hanno saputo la notizia della sua morte, hanno raccontato che la notte del 22 maggio l’avevano sentito urlare a lungo e chiedere l’intervento di un dottore senza mai ricevere risposta. 

E’ in corso un’indagine per omicidio colposo sui fatti avvenuti all’interno del centro detentivo dov’era rinchiuso Moussa quando è deceduto.

Il 14 ottobre scorso durante la prima udienza gli imputati hanno richiesto ed ottenuto il rito abbreviato, quindi il processo andrà avanti a porte chiuse e senza l’ausilio di testimonianze. 

Grazie alla presenza in aula del fratello Amadou Thierno Balde, la famiglia di Moussa si è costituita parte civile. 

Neppure al processo è stata riconosciuta l’aggravante dell’odio razziale, infatti la stessa procura ha deciso di non contestarla, decisione sulla quale l’avvocato della famiglia si opporrà nel dibattimento.

La giudice ha inoltre respinto la richiesta di costituirsi parte civile presentata da tre associazioni operanti nel territorio di Ventimiglia.

Non potendo entrare in aula, un gruppo di solidali si è radunato davanti al tribunale di Imperia e, dopo la rapida udienza, si è spostato a Ventimiglia nel luogo dove avvenne l’aggressione razzista, insieme ad Amadou Thierno Balde. 

Le persone solidali hanno camminato lungo le vie del centro per ricordare che la morte di Moussa Balde non è stata un tragico episodio ma il risultato di un brutale razzismo, anche istituzionale, che si palesa nel trattamento subito dal sopravvissuto al violento pestaggio, il quale è passato dall’ospedale, dal commissariato, dalla questura, dal CPR di Torino, davanti al medico che lo ha valutato idoneo alla detenzione, dall’isolamento disumano senza contatti con l’esterno e senza qualsiasi tipo di cura.

“Il trattamento che ha ricevuto prima di morire nessun individuo, nessun essere umano dev’essere trattato in questa maniera” dice Thierno Balde fuori dal tribunale d’Imperia, parlando del fratello “Perchè non ci siano più ingiustizie o razzismo, perché è duro ma bisogna essere chiari, si tratta di razzismo quello che ha subito. Perché non ci siano più casi così nel mondo intero, in particolare in Italia. Che il diritto in tutto il mondo sia rispettato, il diritto umano.”

La prossima udienza del processo ai tre aggressori sarà al tribunale d’Imperia il 9 dicembre alle ore 13:00.

Per impedire che questa storia finisca nel silenzio, per contrapporsi alla violenza razzista, per la libera autodeterminazione di tutte e tutti.

Per l’abolizione e la chiusura di tutti i CPR.

Moussa Balde died from racism

The trial of three Italians who brutally attacked Moussa Balde in Ventimiglia on May 9, 2021, began at the court of Imperia on October 14th. The attack took place in broad daylight on Ruffini Street between a supermarket and the border police offices. 

The defendants are on trial for injuries aggravated by the number of people and the use of an iron bar. They are being defended by lawyer Marco Bosio, known for having been the defense counsel in the trials against organized crime in western Liguria known as “SPI.GA” and “La Svolta”. 

The attackers were reported because a video of the violence was taken and then spread around the web, in which the defendants are recognizable. 

On the very day of the attack, the Imperia police commissioner rushed to make statements ruling out the racial matrix of the violence, which the defendants justified as a reaction to a phantom attempted robbery without a shred of proof

Institutional racism remains evident, putting in place a protocol not to protect the lynching victim, but rather the Italian people incriminated by the video filmed from a balcony.

In fact, following the attack Moussa Balde (from Guinea) was taken to the hospital for facial trauma and injuries, medicated and discharged the same day. Taken to the police station he was handed over to the immigration office and, checked for his irregularity in the territory, he was imprisoned in the CPR (Centro di Permanenza per il Rimpatrio, or detention center) in Turin awaiting deportation. 

Removed from VentimigliaMoussa ended up at the CPR without ever having signed any testimony about his assault and without being asked any questions about the course of events. He received no psychological examination but was locked up in Turin, where, for several days lawyers were unable to track him down because Moussa had been registered at the CPR under a name different from the one marked by the Imperia police headquarters. 

In isolation in a zone of the CPR called Ospedaletto in TurinMoussa Balde died on the night between May 22nd And 23rd. Fellow prisoners who started a protest when they knew about his death said that on the night of May 22, they had heard him screaming for a long time and calling for a doctor without ever receiving a response. 

A manslaughter investigation is under way into the events that took place inside the detention center where Moussa was confined when he died.

On October 14 during the first hearing, the defendants requested and obtained an abbreviated trial, so the trial will go on behind closed doors and without the aid of witnesses. 

Thanks to the presence of Moussa’s brother Amadou Thierno Balde in the courtroom, Moussa’s family has filed civil 

Not even at the trial was the aggravating factor of ethnic hatred recognized; in fact, the prosecutor’s office itself decided not to challenge it, a decision on which the family’s lawyer will argue in the trial.

The judge also rejected the request for civil action filed by three associations operating in the Ventimiglia area.

Unable to enter the courtroom, a group of solidarians gathered in front of the Imperia courthouse and, after the quick hearing, moved to Ventimiglia to the site where the racist attack took place, along with Amadou Thierno Balde. 

Those in solidarity walked along the streets of the city center to remember that Moussa Balde’s death was not a tragic episode but the result of brutal racism, including institutional racism. This is evident in the treatment suffered by the survivor of the violent beating, who went from the hospital to the police station, the police headquarters to the CPR in Turin, before arriving before the doctor who assessed him fit for detention, inhumane isolation without contact with the outside world and without any kind of care.

“The treatment he received before he died, no individual, no human being should be treated in this way.” says Thierno Balde outside the court in Imperia, speaking of his brother “So that there will be no more injustice or racism, because it’s harsh but you have to be clear, it’s racism what he suffered. So that there are no more cases like this in the whole world, particularly in Italy. Let the right throughout the world be respected, the human right.”

The next hearing in the trial of the three attackers will be at the Imperia court on December 9 at 1 p.m.

Moussa Balde est mort de racisme

Le 9 mai 2021, Moussa Balde, originaire de Guinée, a été brutalement agressé à Vintimille. Le procès des trois Italiens auteurs de cette attaque qui a eu lieu en plein jour rue Ruffini, entre un supermarché et les bureaux de la police aux frontières, a débuté au tribunal d’Imperia le 14 octobre 2022. 

Les accusés sont jugés pour des blessures aggravées par le nombre de personnes et l’usage d’une barre de métal. Ils sont défendus par Marco Bosio, connu pour avoir été l’avocat des accusés dans les procès “SPI.GA” et “La Svolta” contre le crime organisé en Ligurie. Des poursuites sans mesure de privation de liberté ont pu être engagées contre les agresseurs grâce à une vidéo des violences réalisée par une voisine depuis son balcon et qui a fait le tour du web.

Le jour même de l’agression, le chef de la police d’Imperia s’est empressé de faire des déclarations excluant la dimension raciste de ces violences. Les accusés ont justifié leurs actes comme étant une réaction à une prétendue tentative de vol, sans pouvoir en apporter aucune preuve.

Le racisme institutionnel reste évident, mettant en place un protocole non pas pour protéger la victime du lynchage mais plutôt les Italiens incriminés par la vidéo filmée depuis un balcon.

En effet, à la suite de son agression et après un court passage à l’hôpital pour des traumatismes et des blessures au visage, Moussa Balde a été conduit au commissariat de police, remis au bureau de l’immigration et, après qu’ait été vérifiée son irrégularité sur le territoire, il a été enfermé au CPR (Centro di Permanenza per il Rimpatrio, équivalent des centres de rétention administrative) de Turin en attendant son expulsion. 

Éloigné de Vintimille, Moussa s’est retrouvé en détention sans jamais avoir signé de témoignage sur son agression et sans que ne lui soit posée aucune question sur le déroulement des événements. Il n’a bénéficié d’aucun examen psychologique mais a été enfermé à Turin où, pendant plusieurs jours, les avocats n’ont pas pu le retrouver car il avait été enregistré au CPR sous un nom différent de celui retenu par la préfecture de police d’Imperia.

Dans une cellule de l’Ospedaletto, le quartier d’isolement du CPR de Turin, Moussa Balde est mort dans la nuit du 22 au 23 mai 2021. Ses codétenus, qui ont commencé à protester lorsqu’ils ont appris la nouvelle de son décès, ont déclaré que cette nuit-là, ils l’avaient entendu crier pendant longtemps et demander l’intervention d’un médecin sans jamais recevoir de réponse.

Une enquête pour homicide involontaire est en cours sur les événements qui se sont déroulés à l’intérieur du centre de rétention où était enfermé Moussa lorsqu’il est décédé.

 

Ce 14 octobre, lors de la première audience concernant l’agression de Moussa, les accusés ont demandé et obtenu une procédure simplifiée. Le procès se déroulera donc plus rapidement, à huis clos et sans audition de témoins. Grâce à la présence d’Amadou Thierno Balde, le frère de Moussa, la famille a pu se porter civile. 

Déjà écartée dans les déclarations publiques officielles au moment de l’agression, la circonstance aggravante de haine raciale n’a pas été retenue lors du procès. Le procureur a décidé de ne pas la relever, une décision à laquelle l’avocat de la famille s’opposera dans les suites du procès. Le juge a également rejeté la demande de trois associations de Vintimille de se porter partie civile.

Ne pouvant entrer dans le tribunal d’Imperia, un groupe de personnes solidaires s’est rassemblé à ses portes et après la rapide audience, s’est rendu sur les lieux de l’agression raciste à Vintimille avec Amadou Thierno Balde. Ils et elles ont marché dans les rues du centre ville pour rappeler que la mort de Moussa Balde n’est pas seulement un événement tragique mais le résultat d’un racisme brutal, y compris institutionnel, qui apparaît clairement dans le traitement qu’a subi le survivant du lynchage, emmené de l’hôpital au commissariat, de la préfecture de police au centre de rétention, d’un médecin qui l’a jugé apte à la détention jusqu’à un isolement inhumain, sans contact avec le monde extérieur et sans aucun type de soins.

« Le traitement qu’il a reçu avant de mourir, aucun individu, aucun être humain ne devrait être traité de cette façon. Pour qu’il n’y ait plus d’injustice ou de racisme, parce que c’est dur mais il faut être clair, c’est du racisme qu’il a subi. Pour qu’il n’y ait plus de cas comme celui-ci dans le monde entier, et en particulier en Italie. Que l’on respecte le droit dans le monde entier, le droit humain. » a déclaré Amadou Thierno Balde à la sortie du tribunal d’Imperia, en parlant de son frère Moussa.

 

La prochaine audience dans le cadre du procès des trois agresseurs de Moussa Balde aura lieu au tribunal d’Imperia le 9 décembre à 13h.

Pour éviter que cette histoire ne termine dans le silence, pour s’opposer à la violence raciste, pour la libre autodétermination de toustes.
